This website is operated by Paw Peak Care Pte Ltd. Throughout the site, the terms “we”, “us” and “our” refer to Paw Peak Care Pte Ltd. We offer this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

Please read these Terms of Service carefully before accessing or using our website. By accessing, using any part of the site, and/or purchasing something from us, you agree to be bound by the following Terms and Conditions (“Terms of Service”, “Terms”), including additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content. If you disagree with any of the terms of this agreement, then you may not access the website or use any services. A breach or violation of any of the terms will result in immediate termination of our services to you.

We reserve the right to update, change or replace any part of these Terms of Service on our website at any time without prior notice to users. It is your responsibility to check this page for changes. Your continued access or use of the website constitutes acceptance of those changes.

 

2. Online store terms

By agreeing to these Terms of Service, you affirm that you are either more than 18 years of age, or possess legal parental or guardian consent, and are fully able to comply with these terms.

You may not use our products or this site for any purpose that is unlawful or prohibited by these Terms, or to solicit the performance of any illegal activity or other activity which infringes the rights of Paw Peak Care or others. Notwithstanding any other rights or restrictions in these Terms of Service, you may not use this site to: (a) transmit via or through the site any information, data, text, images, files, links, or software except in connection with your authorised use of this site or otherwise in response to specific requests for information by us; (b) introduce to the Site or any other computer or web site viruses, worms, Trojan horses and/or harmful code; (c) obtain unauthorised access to any computer system; (d) impersonate any other person, including but not limited to, a registered user of this site or an employee of Paw Peak Care; (e) invade the privacy or violate any personal or proprietary right (including intellectual property rights) of any person or entity; (f) misrepresent the identity of a user or use a false email address; (g) tamper with or obtain access to this site or any component of this site; (h) conduct fraudulent activities; or (i) collect or harvest information regarding other users of the site for any reason whatsoever, including, without limitation, for sending such users unsolicited commercial email.

 

3. General conditions

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (excluding credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.


4. Accuracy, completeness and timeliness of information

While we endeavour to be as accurate, complete and reliable as possible when making information available on the site, we do not guarantee the accuracy or completeness of any information. There may occasionally be information on our site or in the service that contains errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, availability or other information. Errors will be corrected as soon as practicable.

We reserve the right to: (i) revoke any stated offer; (ii) correct any errors, inaccuracies or omission; and (iii) make changes to prices, content, promotion offers, product descriptions or specifications, or other information without obligation to issue any notice of such changes (including after an order has been submitted, shipped or received). We also reserve the right to limit quantities (including after an order has been submitted and/or acknowledged) and to revise, suspend or terminate an event, promotion at any time without notice. The inclusion of any products or services on this site at a particular time does not guarantee that the products or services will be available.

The content on this site is provided for general information only and any reliance on the information on this site is at your own risk. We reserve the right to modify the contents of this site at any time where we deem fit. You agree that it is your responsibility to monitor changes to our site.

 

5. Modifications to the service and prices

Prices for our products are subject to change without prior notice. We reserve the right to amend the prices listed on this site and modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

 

6. Products or services

All product descriptions, pricing and availability are subject to change at any time without prior notice. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

6a. Order Acceptance

Your order confirmation upon payment does not constitute a legally binding contract between Paw peak Care and you. We reserve the right to cancel or reject any order that we have received, or limit quantities purchased, and refund the payment to you without prior notice. This includes orders relating to suspected fraud, unauthorised or illegal activity, or products sold due to any errors on our site.

All products are subject to availability. In the event any product in an order is unavailable, we reserve the right to proceed with the remaining order or to cancel the order and adjust the final bill accordingly. There will not be any replacement or subsequent deliveries for the unavailable product(s).

6b. Delivery Information

Delivery is free for orders S$60 (net) and above, otherwise, there will be a delivery charge of S$4.90. In the event that there are any order adjustments and the revised total amount falls under S$60, the delivery surcharge of S$4.90 will apply.

We deliver to all places in Singapore, including Sentosa, other than restricted areas/postcodes and PO boxes. We strive to dispatch all orders within 3 working days of your order submission. The standard turnaround time for delivery is 2-3 working days.

Items purchased from our site are shipped by a third party carrier pursuant to a shipment contract. Risk of loss and title for such items pass to you upon our delivery to the carrier.

Please ensure that an authorised recipient is able to receive the delivery at the stated address. A re-delivery surcharge of S$15 will apply after the third unsuccessful delivery attempt.

If you did not receive your order, or if there are missing items, please let us know by email to hello@pawpeakcare.com within 3 days of delivery/expected delivery and we will try our best to assist.

We shall not be held liable for any delays in the event any order takes longer to process and deliver. This includes delays during peak periods, holiday periods and unforeseen circumstances.

6c. Cancellation, Returns, Refunds

Orders cannot be amended or cancelled once payment has been made. 

Please check your items upon receipt of your order. If you find any wrong, damaged or defective item, please let us know within 5 days of delivery by sending us an email to hello@pawpeakcare.com with a description and clear photo(s) of the defect(s). Items may need to be returned unused and in their original packaging and condition. We will not be liable for claims after the stated timeline.

A defective product shall be defined as one which:

  • contains missing parts required for operation or use
  • damaged packaging that compromises the safety of use

We will exchange the product if:

  • it was delivered in a damaged condition or is past its expiry date
  • it has a manufacturer’s defect
  • the wrong product was delivered

 

7. Accuracy of shipping, billing and account information

Order submissions require your registration of an account with us, which will include the provision of your personal and contact information such as name, mailing address, email address and contact number for the purpose of billing and shipping. By providing your contact details, you are confirming that the information is consistently accurate and updated. Inaccurate shipping information will result in failed delivery and hence additional charge for re-delivery. Collection of your personal information is in accordance with our Privacy Policy.

You are responsible for maintaining the confidentiality of your account login information. Please keep your password secure and limit the access of your account to yourself. You agree that you will be responsible for all activities that occur under the account. If you suspect or become aware of any unauthorised use of your account, please let us know immediately.

We reserve the right to cancel any account that has been inactive for a long time, if it is found to have inaccurate information or if it is determined that the account may be compromised or used for fraudulent purposes.

In a credit card transaction, you must use your own credit card. We will not be liable for any credit card fraud. The liability to use a card fraudulently will be on the user and the onus to 'prove otherwise' shall be exclusively on the user.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

 

8. Third-party links

Our service may contain materials and links to third-party websites on the Internet. You acknowledge that we have no control over such materials and websites and that we are not responsible for the accuracy, content, legality, privacy policy or any other aspect of any third-party materials and linked websites. We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites.


 9. User comments, feedback and other submissions

Any comments, ideas,messages, suggestions or other communications or information posted on the Site ("Submissions"), submitted to Paw Peak Care Pte Ltd., or otherwise communicated in connection with your use of the Site shall be and remain the exclusive property of Paw Peak Care Pte Ltd. with no further compensation to you. You agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any submissions that you make to us. We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.

You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

Your use of our services and this site, including submission of personal information is subject to our Privacy Policy.

11. Prohibited uses

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content:

(c) to violate any laws;

(d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; 

(f) to submit false or misleading information; 

(g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; 

(h) to collect or track the personal information of others; 

(i) to spam, phish, pharm, pretext, spider, crawl, or scrape; 

(j) for any obscene or immoral purpose; or 

(k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. 

We reserve the right to deny you access to our site and terminate your use of the Service or any related website for violating any of the prohibited uses.

The site, it's content, products and other information on or linked to this site are provided on an "as available" and "as is" basis without warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that your use of this site will be uninterrupted, timely, secure, error-free or free of computer virus or other malicious programmes.

Information and statements provided through this site are for informational purposes only and are not intended to diagnose, treat, cure, or prevent any disease, injury or other medical condition.­ We do not warrant that any information on or linked to this site is complete and/or accurate. Professional veterinary care is required for specific medical conditions and medication.

Unless explicitly stated, we disclaim all warranties with respect to products sold on this site, including but not limited to merchantability and fitness for a particular purpose. You agree that the sole and exclusive maximum liability to us arising from any product sold on the site shall be the price you paid for the product ordered. In no event shall Paw Peak Care, its directors, employees and representatives be liable for special, indirect, consequential or punitive damages related to product sold.

By using this Site, you agree to indemnify, hold harmless and defend Paw Peak Care Pte Ltd., its subsidiaries and affiliates, and their respective directors, employees, partners, contractors, vendors, manufacturers, distributors, representatives and affiliates from any claims, damages, losses, liabilities, and all costs and expenses of defense, including but not limited to, attorneys' fees, resulting directly or indirectly from a claim (including without limitation, claims made by third parties for infringement of intellectual property rights) by a third party that arises in connection with your use or misuse of the Site, your breach of the Terms of Service, or your violation of any law or the rights of a third party.

 

14. Severability

If at any time any provision of these Terms of Service shall be or shall become unlawful, invalid or unenforceable in any respect, the legality, validity and enforceability of the remaining provisions of this agreement shall not be affected or impaired thereby, and shall continue in force as if such unlawful, invalid or unenforceable provision was severed from these Terms of Service.

You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
